The Company provides heating, ventilation, and air conditioning (HVAC) services, including installation of new systems, maintenance, repair, and replacement of existing systems. All services are subject to the terms of this agreement.
Note: All terms, limitations, and protections outlined in this agreement apply equally to the installation of new HVAC systems as well as repair, service, and maintenance of existing systems.
2. Acceptance of Terms
By using this website, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and the conditions set forth herein.
3. Limitation of Liability
To the maximum extent permitted by law, the Company and its employees, agents, or contractors shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to property damage or personal injury, arising from the use of this website or services, including the installation of new HVAC systems. This limitation applies even if the Company has been advised of the possibility of such damages.
4. Warranty Disclaimer
All services and products provided by the Company are “as is” and “as available”. The Company expressly disclaims all warranties, whether express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose, except where explicitly stated in writing.
Additional Note for Installation: Any new HVAC system installation carries inherent risks, and the Company’s warranty covers workmanship only as explicitly stated in writing. Manufacturer warranties may apply separately to the installed equipment.
5. Indemnification
You agree to indemnify and hold harmless Bay Tech Heating and Cooling Inc., its affiliates, employees, agents, and contractors from any claims, losses, damages, liabilities, costs, or expenses (including reasonable attorney fees) arising out of your use of the website or services, including installation, repair, or maintenance, or your violation of these Terms.
6. Dispute Resolution
Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the laws of the Province of Ontario, Canada. The parties waive any right to a trial by jury or court litigation to the extent permitted by law.
7. Termination
The Company reserves the right to suspend or terminate access to the website or services at any time, without prior notice, if these Terms are violated or in the event of misuse.
8. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada.

9. Use Restrictions
Users shall not use the website or services for any illegal, harmful, or unauthorized purpose. Any misuse is the sole responsibility of the user.
10. Electronic Agreement

All claims or disputes must be submitted within six (6) months from the date the alleged issue occurred. Claims submitted later are barred.

14. Acknowledgment of Risk
The client acknowledges that certain risks are inherent in HVAC services, including new system installation, and the Company’s responsibility is limited to performing services in a professional manner consistent with industry standards.
15. Amendments
The Company reserves the right to update or modify these Terms at any time. Updated terms will be posted on the website and are effective immediately upon posting.
16. Data & Privacy Protection
Any information provided by users will be protected in accordance with privacy laws. The Company is not responsible for unauthorized access or misuse except in cases of gross negligence or willful misconduct.
17. Third-Party Services
The Company is not responsible for services or content provided by third parties, including external links, suppliers, or contractors.
18. No Guarantee of Specific Results
The Company does not guarantee any specific outcome or result from the services provided, including new system installation.
19. Content Use Restrictions
No user may copy, reproduce, or distribute any content, logo, or materials from the website without explicit written permission from the Company.
20. Intellectual Property Rights
All content, designs, trademarks, and branding on the website are the property of the Company and protected by law.
21. Safety & Compliance
The user acknowledges that services, including installation of new HVAC systems, are performed only by qualified personnel and in compliance with applicable safety standards and laws. Any attempt to alter, interfere, or perform unauthorized work is the user’s responsibility.
22. Emergency Service Changes
The Company may modify, suspend, or temporarily halt services during emergencies or potential hazards without liability.
